TERMS OF SERVICE

By commissioning me in any kind of way, you are agreeing to the terms of service below

By commissioning me, you agree that you have read and
accepted all the terms described herein.
You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.
| I. GENERAL TERMS |

| Fixed price and TAT (Turn Around Time) will be discussed with client individually |
| I reserve the right to change price of commission based on number of details |
| Price and TAT will be stated before commission |
| You reserve the right to set a deadline for your commission. The deadline must be stated and disclosed before payment and might add rush fee |
| I have the right to decline a project if there is too short of a time allowance |
| Rush fees starts at +25% price of commission |
| Rush fees might vary depending on type of commission and given timeframe |
| Any ill behaviour won't be tolerated - your commission will be canceled |
| I have the right to decline your commission for any reason |
| The responsibility is on you to ensure your order contains the details you want me to follow |
| I reserve the right to charge fees for too many changes in your commission |
| If your reference was unclear to start with, then you are not allowed to do changes without a fee |
| I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it |
| II. PAYMENT |

| I am not responsible for any mistakes that are made on your part over the course of the transaction |
| The currency accepted is : Euro via PayPal inovoice or ko-fi commissions |
| You are responsible for making currency conversions |
| It is expected that you deposit 100% of the price before I start working on your project OR we can discuss: 50% before the sketch and the other 50% once your commission has been completed. No exceptions unless otherwise discussed |
| I won't start working on your commission before the payment |
| Do not send me any kind of payment until I have confirmed I can accept your commission AND have asked for payment |
| III. CANCELING / REFUNDING POLICY |

| I will not issue any refunds after the commission has been completed or if you change your mind after approving the sketch |
| I will not issue any refunds when commission was canceled due to your ill behavior |
| If I for some reason do not deliver your commission or send any updates for 90 days, I will issue a full refund |
| You are NOT authorized to issue a chargeback for any reason |
| You are required to contact me when you need to cancel a commission |
| If you decide to cancel a commission mid process the % of refunded payment will be decided based on how far I am from completing your commission |
| V. COPYRIGHT / USAGE POLICY |

| I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. I reserve the right to do whatever I wish with the art (eg. post it to other sites such as Instagram) but will give proper credit to you for ownership of the character’s design |
| You, the Client, may display my work on external sites as long as it is visibly credited and linked back to me |
| You may not claim my work as your own |
| You may use the Artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays |
| I reserve the right to post your finished artwork in my gallery for any reason |
| I do not allow my art to be used for AI purposes and alike. Please do not upload it to any AI sites, filters or other kinds of AI generators. Doing so will immediatly put you on a blacklist for future commissions |
| NFT usage is strictly forbidden |
| You may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless otherwise discussed |
| VI. COMMERCIAL USAGE AGREEMENT |

| If you, the Client, wish to order a commission for Commercial use, the total price of the commission will be agreed upon upfront |
| The following cases are considered commercial use: Reproducing and selling the artwork, publicly or privately, cases where you receive profit from a medium/platform where you have posted my artwork, (eg. Patreon, YouTube, Twitch, a personal site, business cards etc) |
| The minimum price increase is +100% of the original price, meaning double the end sum. However, I reserve the right to charge more |
| VII. PRIVACY REQUEST |

| If you wish for your request to be private, it must be stated during the ordering process |
| The privacy request entails that I am not allowed to share any WIPs on social media, nor am I allowed to stream the process of the commission anywhere |
| I reserve the right to charge a fee if I deem fit |
